G-5 Visa - Frequently Asked Questions

Does my child who is at a boarding school qualify as a member of the immediate household for the purpose of G-5 visa?

Yes, your child qualifies as an immediate relative, even though he or she is actually absent from the household for a large part of the year while attending a boarding school or college.

Does my adopted child qualify as a member of the household for the purpose of G-5 visa?

Children who are subject to a full and final adoption by the principal G-5 applicant are considered immediate family members.

What are the legal rights and resources available for G-5 and A-3 domestic workers?

The G-5 and A-3 domestic workers are protected from exploitation and abuse by U.S. federal law, which includes the Fair Labor Standards Act, as well as contract law and state law, both of which provide additional protections. Here you can get the information about what rights domestic workers are entitled to and how to detect potential exploitation or abuse. The information can be used to educate the domestic workers about their rights and help them locate culturally appropriate social services.

Are G-5 visa holders entitled for medical insurance?

An employer who offers their G-5 employee medical insurance that is in addition to the agreed compensation and who pays this amount directly to the insurance provider may treat Medical Insurance as a non-taxed item. Most G-5 employers, however, contractually agree to assist the employee in obtaining medical insurance and deduct the premiums from the employee's pay to forward to the insurer as a convenience to the G-5 employee. The amount of the insurance premium deducted is deducted as an 'after tax' item, and the employee's insurance premium is not deducted from his/her gross payroll.

When is a person eligible to recruit a G-5 domestic worker?

The employer is a designated principal resident representative of a foreign government to an international organization or an accredited resident member of that representative's staff; an accredited representative of a foreign government to an international organization; an officer or employee of an international organization; or a member of the employer's immediate family.
